Welcome to the Oojo.com website (the "Website"). This Website provides assistance for customers in gathering travel information, determining the availability of travel related goods and services, and for no other purposes.

The terms "we", "us", "our", "Oojo" refer to Oojo International B.V., a company registered and existing in the Netherlands at: Rokin 69A, 1012 KL Amsterdam, Netherlands. The terms "you" or "your" refer to the customer visiting and using the Website.

The Website is offered to you conditioned upon your acceptance without modification of any of the terms, conditions, and notices set forth below (collectively, the "Terms of Use"). Please read these Terms of Use carefully before using, accessing, or obtaining any information, products or services from the Website. You should also read our Privacy Policy, which details how we collect and use your personal data, including in connection with your use of the Website, and is incorporated by reference in this Terms of Use. By using the Website, you agree to be bound by these Terms of Use. If you do not agree to the Terms of Use and Privacy Policy, you should not access or use the Website.

We may amend and modify these Terms of Use for any reason at any time at our discretion by posting a new version if it on the Website; these changes do not affect rights and obligations that arose prior to such changes. If you continue using the Website following the posting of modified Terms of Use, you will be deemed to have agreed and accepted any amendments and will be subject to the Terms of Use in effect at the time of your use. You can determine when these Terms of Use was last revised under “Last revised” legend at the top of these Terms of Use. Please review these Terms of Use periodically for changes. If you object to any provision of these Terms of Use or any subsequent modifications to these Terms of Use or become dissatisfied with the Website in any way, your only recourse is to immediately terminate the use of the Website.

WHAT WE DO

Oojo is a platform operator and travel content distributor, which promotes the content of Travel Providers and provides you with the travel information offered by the Travel Provider.

Oojo performs operating activities on Website, including:

  • Website administration and publishing, updating and deleting content and information about possible Travel Products on the Website;
  • users attraction and assistance with Website navigation, including connecting them with Travel Provider;
  • provide customer support and redirecting it to customer support of Travel Provider.

Not all of the travel services and products that you can access through the Website are provided, owned or controlled by us. The travel services and products displayed on the Website can include flights or any other travel-related services (the "Travel Products"). Depending on the currency, the Travel Products can be owned, controlled, or made available by Oojo or by third parties either directly (e.g., airline) or as an agent (e.g., consolidator or travel agency) (together, the "Travel Providers"). The Travel Providers are responsible for the Travel Products. The Website clearly indicates, who is responsible for the respective Travel Product. Oojo hosts the content obtained from the Travel Providers, publishes, updates and deletes it in accordance with the Travel Providers instructions and is not responsible for controlling or setting any of the travel options or products obtained from the Travel Providers.

When you make a booking, it’s directly with the Travel Provider. Consequently, we’re not always the “contractual party” to your booking. When booking, you enter into (i) an agreement with Oojo, (ii) an intermediation contract for the ticket purchasing with the Travel Provider (consolidator, local travel agent), and/or (iii) a contract of carriage with the airline (for the flight itself). That means that the Travel Provider’s terms and privacy policies apply to your booking so you must agree to and understand those terms. Furthermore, the terms of the actual Travel Provider (Oojo, airline, hotel, tour operator, etc.) apply to your travel, so you must also agree to and understand those terms. If you book any extras (e.g. additional baggage, etc.), you’ll enter into a direct contract with the Travel Provider or another company. Your interaction with any Travel Provider accessed through the Website is at your own risk. Oojo does not bear any responsibility should anything go wrong with your booking or during your travel, in case Oojo is not your contractual party (i.e. Travel Provider).

BOOKING WITH THE TRAVEL PROVIDER

A booking trough this Website means that you book Travel Product(s) from the Travel Provider and enter into agreement with the Travel Provider relating to the provision of the required Travel Product(s).

The specific Terms and Conditions for Travel Products Purchasing will be applicable to your booking, depending on the currency you choose:

By using the Website, you acknowledge that the rates displayed at the Website obtained from the Travel Providers. Oojo has no control over the Travel Products, not provided, owned or controlled by us, and thus it can not guarantee the prices displayed on the Website. You shall be aware that prices change constantly, and additional charges (payment fees, services fees, taxes and other charges) may apply.

If you make a booking through the Website, that booking is made with the Travel Provider and the Website only acts as a user interface. Accordingly, unless Oojo, in that particular case, acts as a Travel Provider, Oojo has no responsibility for the booking or for the Travel Product because Oojo has no involvement in creating the description of the Travel Product, or in providing the Travel Products that you book. If you have any issues or disputes with respect to your booking and/or the Travel Product, you agree to address and resolve all the issues with the Travel Provider directly and not with us (unless in that particular case we act as well as a Travel Provider). All airline tickets booked through the Website are e-tickets. The e-ticketing system is a paperless method to buy airline tickets. Once you have made your booking, you will receive a confirmation email with your flight booking reference number(s). Please note that you will not receive a paper ticket to show at the airport.

USE OF THE WEBSITE

As a condition of your use of the Website, you warrant that:

  • you are at least 18 years of age;
  • you possess the legal authority to create a binding legal obligation;
  • you will use this Website in accordance with these Terms of Use and Privacy Policy;
  • you will only use this Website to make legitimate reservations for you or for another person for whom you are legally authorized to act;
  • you will inform such other persons about the Terms of Use and Privacy Policy that apply to the reservations you have made on their behalf, including all rules and restrictions applicable thereto;
  • all information supplied by you on this Website is true, accurate, current and complete. If any of your information changes, you must immediately update it;and
  • if you have an Oojo.com account, you will safeguard your account information, including your passwords and login, and will supervise and be completely responsible for any use of your account by you and anyone other than you. If you have any reason to believe that your account is no longer secure, you must promptly change your personal information that is affected.

We retain the right at our sole discretion to deny access to anyone to the Website at any time, for any reason and without any notice or liability, including, but not limited to, for violation of these Terms of Use.

PROHIBITED ACTIVITIES

The content and information on the Website (including, but not limited to, prices and availability of Travel Products) as well as the infrastructure used to provide such content and information, is proprietary to us or our Travel Providers. While you may make limited copies of your travel itinerary (and related documents) for travel or service reservations booked through the Website, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software or Travel Products obtained through the Website.

Additionally, you agree not to:

  • use the Website or its contents for any commercial purpose or for any unlawful purpose;
  • make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;
  • access, monitor or copy any content or information of the Website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
  • violate the restrictions in any robot exclusion headers on this Website or bypass or circumvent other measures employed to prevent or limit access to this Website;
  • take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
  • restrict or inhibit any other visitor or member from using the Website, for example by means of "hacking" or defacing any portion of the Website;
  • transmit (a) any content or information that is unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene or otherwise objectionable, or infringes our or any third party's intellectual property or other rights; (b) any material, non-public information about companies without the authorization to do so; (c) any trade secret of any third party; or (d) any advertisements, solicitations, chain letters, pyramid schemes, investment opportunities or other unsolicited commercial communication (except as otherwise expressly permitted by us);
  • remove any copyright, trademark or other proprietary rights notices contained on the Website;
  • engage in spamming or flooding;
  • transmit any software or other materials that contain any viruses, worms, trojan horses, defects, date bombs, time bombs or other items of a destructive or harmful nature;
  • deep link to any portion of this Website (including, without limitation, the purchase path for any travel services) for any purpose without our express written permission; or
  • "frame", "mirror" or otherwise incorporate any part of this Website into any other website without our prior written authorization.

If your booking or account shows signs of fraud, abuse or suspicious activity, we may, at our sole discretion, at any time and without any notice or liability, to suspend, terminate or restrict your access to all or any content on the Website as well as to close your account. If you have conducted any fraudulent activity, Oojo reserves the right to take any necessary legal action and you may be liable for monetary losses to Oojo, including litigation costs and damages. You can always delete your account or address your concerns regarding the closure of an account by contacting Oojo Customer Service.

TRAVEL PROVIDER RULES

Additional terms and conditions will apply to your reservations and bookings of Travel Products that you select on the Website. Please read these additional terms and conditions very carefully. In particular, if you have purchased an airfare, please ensure you read the full terms and conditions of carriage issued by the specific Travel Provider (airline), which can be found on its website. You agree to abide by the terms and conditions of purchase imposed by any Travel Provider with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with its rules and restrictions regarding availability and use of fares or Travel Products. Airfare is only guaranteed once the purchase has been completed and the tickets have been issued. Travel Providers may change their prices without notice. Travel Providers reserve the right to take action leading to the cancelation of your booking if full payment is not received in a timely fashion.

Some Travel Products may also be sold in another currency that the one present of chosen by you for the display of the search results for convenience purposes. Our currency conversion is for informational purposes only and should not be relied upon as accurate or current. As a result, when you book, the amount charged to your payment credit card by your payment provider (e.g. your credit card company) may be slightly different. Your statement may also include a charge conversion fees or fees from your payment provider to process the transaction, plus any applicable taxes (if any).

You acknowledge that some Travel Providers offering certain Travel Products may require you to sign their liability waiver prior to participating in the Travel Product they offer. You shall understand that any violation of any such Travel Provider's rules and restrictions may result in (i) cancellation of your reservation(s) by the Travel Provider, (ii) you being denied access to the applicable Travel Product, (iii) your forfeiting any monies paid for such reservation(s), and / or (iv) the Travel Provider debiting your account for any costs it incurs as a result of such violation.

WARRANTY DISCLAIMER

All information, software and Travel Products published on the Website are provided on "as is" basis without a warranty of any kind. The information, software and Travel Products may include inaccuracies or errors. Oojo does not guarantee the accuracy of and disclaims all liability for any errors or other inaccuracies relating to the information and description of the Travel Products displayed on the Website, including prices. Since Oojo has no control over all Travel Products, it is not possible for us to guarantee the prices displayed on the Website. You must always check whether the price asked for a booking is the one you expected.

Oojo makes no guarantees about the availability of specific Travel Products. Oojo may make improvements and/or changes on the Website at any time.

Oojo makes no representations about the suitability of the information, software and Travel Products contained on the Website, and the inclusion or offering of any Travel Products on the Website does not constitute any endorsement or recommendation of such Travel Products by Oojo.

Oojo and the respective Travel Providers expressly disclaim to the fullest extent permissible all warranties of any kind, whether express or implied, including but not limited to, any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and security and accuracy, as well as all warranties arising by usage of trade, course of dealing, or course of performance.

LIMITATION OF LIABILITY

Oojo shall not be liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any other Travel Providers or for any personal injuries, death, property damage, or other damages or expenses resulting from the Travel Providers acts.

Oojo have no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes, and they have no responsibility for any additional expenses, omissions, delays, re-routing or acts of any government or authority.

In no event shall Oojo and/or the respective Travel Providers be liable for any direct, indirect, punitive, incidental, special or consequential damages or losses of any kind (including, without limitation, loss of use, loss of data, lost profits and / or lost savings), whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise arising out of, or in any way connected with:

  • your access to, display of or use of the Website, download or use of any content from the Website and / or with the delay or inability to access, display or use the Website;
  • any computer viruses, information, software, linked sites and Travel Products obtained through the Website, that may infect your computer equipment or other property;
  • the performance or nonperformance by Oojo or the Travel Provider, even if Oojo and/or the respective Travel Providers have been advised of the possibility of such damages.

If, despite the limitation above, Oojo and / or the respective Travel Providers are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then the liability of Oojo and / or the respective Travel Providers will in no event exceed the total charges set forth in the Travel Product documents giving rise to any such liability.

You may be protected by mandatory consumer protection laws and regulations, which guarantee you rights that no company’s terms can overrule. If there is any inconsistency between those laws and regulations and these Terms of Use, such mandatory consumer protection laws and regulations will override.

INDEMNIFICATION

You agree to defend and indemnify and hold Oojo and / or the respective Travel Providers together with any of their officers, directors, employees and agents harmless from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

  • your breach of these Terms of Use or the documents referenced herein;
  • your violation of any applicable law or the rights of a third party; or
  • your use of or access to the Website.

LINKS TO THIRD-PARTY SITES

The Website may contain hyperlinks to other websites operated by parties other than Oojo, for which Oojo are not responsible. Such hyperlinks are provided for your reference and convenience only. We do not control such websites and are not responsible or liable for them, their content or the privacy or other practices of such websites and accept no responsibility or liability for any loss or damage that may arise due to your use of them. It is up to you to take precautions to ensure that whatever links you select or software you download (whether from the Website or other websites) is free of such items as viruses, worms, trojan horses, defects and other items of a destructive nature. You should refer to the terms of use, privacy policies and other rules stated on these websites before you use them. Our inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators.

APPLICABLE LAW AND DISPUTES

These Terms of Use are governed by Dutch law. You can also rely on your national consumer law if you are a consumer living in a country in the European Economic Area, UK, or Switzerland (“Europe”).

If you are a consumer living outside Europe, to the extent permitted by mandatory local (consumer) law, these Terms of Use are governed by Dutch law.

To the extent permitted by applicable law, you agree that any disputes, claims and causes of action arising out of or connected with the Website and / or these Terms of Use, will be resolved individually, without resort to any form of class action.

Any and all disputes you have relating in any way to the services or your relationship with Oojo (including, without limitation, with respect to data, your interaction with Oojo, Oojo’s advertisements and disclosures, email and mobile text messages Oojo sends to you, or the use or disclosure of any information about you), these Terms of Use (collectively, “claims”) you agree first send to Oojo a written Notice ("Notice"). The Notice to Oojo must be sent to [email protected]. The Notice shall describe the nature and basis of the claim or disputes and the specific relief sought. If you and Oojo cannot reach an agreement to resolve the claim within thirty (30) days after the Notice is received, you may use any option provided below to protect your legal interests.

If you are a consumer living in Europe (as defined above):

  • You may bring a legal action against us:
  • in the courts of the country where you live, or
  • in the courts of Amsterdam.
  • We may bring a legal action against you in the courts of the country where you live.

If you are a consumer living outside Europe, to the extent permitted by mandatory local (consumer) law, any dispute will exclusively be submitted to the court of Amsterdam.

INTELLECTUAL PROPERTY

Oojo, the Travel Providers and other licensors, own all of the text, images, software, trademarks, service marks and other material contained on the Website. You must not copy or transmit any of the material except for your personal, non-commercial purpose. Other product, service, logos or company designations on the Website, that are not Oojo’s, belong to the respective third parties and may be mentioned on the Website for identification purposes only. You should contact the respective third party for more complete information regarding such designations and their registration status. Your use of and access to the Website does not grant you any license or right to use any of the marks mentioned on the Website.

TERMINATION

We reserve the right to immediately terminate the agreement between you and us if you breach any of these Terms of Use. Our performance is subject to existing laws and legal process, and nothing contained in these Terms of Use limits our right to comply with law enforcement or other governmental or legal requests or requirements relating to your use of the Website or information provided to or gathered by us with respect to such use.

If any part of these Terms of Use is found to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions, or the affected part thereof, will not in any way be affected or impaired. Our failure or delay in enforcing any provision of these Terms of Use at any time does not waive our right to enforce the same or any other provision(s) hereof in the future.

Except as expressly provided in a particular notice or disclaimer poste by or on behalf of Oojo, these Terms of Use (and any other terms and conditions or policies referenced herein) constitute the entire agreement between you and Oojo with respect to the Website, our services and your relationships with us. It supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us. A printed version of these Terms of Use and of any notice given in electronic form shall be admissible in judicial, arbitration or any other administrative proceedings to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Fictitious names of companies, products, people, characters, and/or data mentioned on the Website are not intended to represent any real individual, company, product, or event.
